§ 2112. Actions against insurers

The insured party in any suit for damages arising under the provisions of this chapter against an insured person may sue the insurer separately or jointly with the insured person. The action against the insurer shall be subject to the responsibility limits and to the conditions of the insurance contract including any condition which makes the insurer responsible irrespective of the legal responsibility of the insured person. The insurer may raise against the injured party the defenses which the insurer may have against the insured person.
