§ 946. Barbiturates and other dangerous drugs—Approval and judicial review of regulations

(a) The Secretary of Health shall approve and promulgate the regulations governing and controlling the sale, possession, prescription and distribution of the barbiturates, antibiotics and other dangerous drugs to which §§ 930—949 of this title refer; the labeling of the containers in which same are dispensed; the filling and the copies of the prescriptions as regulated by §§ 930—949 of this title; the preparation and safekeeping of the vouchers which shall be kept by the drugstores and hospitals according to the provisions of §§ 930—949 of this title; and with respect to any other aspect necessary to enforce the public policy of §§ 930—949 of this title.

(b) Said regulations shall be approved after a public hearing which shall be held ten (10) days after their publication in a newspaper of general circulation in Puerto Rico.

(c) The regulations approved by the Secretary of Health shall take effect on the date set by said official but never before fifteen (15) days following the date the public hearing is held.

(d) Any person who considers himself aggrieved by the regulations approved by the Secretary of Health may request a judicial review thereof before the Court of First Instance of Puerto Rico within fifteen (15) days from the effective date of such regulations.

(e) In approving amendments to the regulations the same procedure and rules determined in this section for the approval of the original regulations shall be followed.
