§ 2555. Licenses—Application

(a) Every applicant for a license to practice as health educator or as community health educator in Puerto Rico shall file his application before the Board on an official form prepared by the latter, and shall accompany said application with a postal money order drawn to the order of the Secretary of the Treasury in the amount of ten dollars ($10). Provided, That candidates to the examination shall pay an additional twenty-five dollars ($25) in a postal money order to the order of the Secretary of the Treasury. The fees paid for said licenses shall go to the Health Fund.

(b) Candidates who do not pass the examination provided by this chapter shall have the opportunity for a reexamination up to three times within the term specified in the regulations and upon payment of a twenty-five-dollar ($25) fee to take for each examination; Provided, however, That the candidate who fails three (3) times shall prove to the Board that he/she has taken improvement courses in order to be granted a new opportunity. After the candidate has approved the courses to the satisfaction of the Board, he or she shall have two (2) additional opportunities to take the examination. Should said courses not be available, the candidate shall be exempted from this requirement and shall be granted up to two (2) opportunities to take the examination.

(c) The Board shall issue duplicates of licenses upon proof that the candidate shows to the satisfaction of the Board that his original license has been lost or has been destroyed and includes a postal money order to the order of the Secretary of the Treasury in the amount of five dollars ($5) for the issuing of the new license.

(d) The Board shall charge the following fees:

For each examination $ 25.00

First license $ 75.00

Provisional license $ 25.00

Duplicate license $ 15.00

Recertification $ 75.00

The fees thus collected by the Board shall not be refunded under any circumstance. The recertification shall be made every three (3) years. The amounts collected shall be covered into the Health Fund through a check or money order, to be used by the Office of Regulation and Certification of Health Professionals of the Department of Health.

(e) Compliance with the continuing education requirement established by the Board shall be mandatory in order to obtain the recertification.

(f) The Board shall issue a license without the examination requirement to every person who meets the following requirements:

(1) In the case of health educators, the person shall hold a master’s or doctor’s degree or title in health education from an accredited university or college, which shall have been approved on or before July 31, 1975, and who complies with the provisions of subsection (a) of this section and meets all the requirements provided in subsections (a) and (b) of § 2556 of this title.

(2) In the case of a community health educator he must hold a bachelor’s degree in health education from an accredited university or college which shall have been approved on or before the date of approval of this act, and who complies with the provisions of subsection (a) of this section and meets all the requirements provided in subsections (a) and (b) of § 2556 of this title.

(3) Every person who meets the requirements provided in this chapter to obtain a health educator’s or community health educator’s license without having to fulfill the examination requirement must apply for the same before the Board within the first six (6) months after the approval of this act; Provided, That those who do not apply for it within said term shall lose the right to a license without taking the examination.
