§ 853. Guarantee

(1) Express guarantee.— The express guarantee of assistive technology equipment shall cover any change or adjustment that is done thereto by virtue of the specific needs of a person with a disability. The manufacturer, supplier, distributor, authorized dealer, or authorized lessor, as the case may be, shall honor said guarantee.

(2) Term of the guarantee.— Every manufacturer, supplier, distributor, authorized dealer, or authorized lessor, as the case may be, shall provide a guarantee of not less than one (1) year for parts and labor from the time the equipment is delivered to the consumer.

(3) Compliance with the guarantee.— The manufacturer, supplier, distributor, authorized dealer, or authorized lessor, as the case may be, who receives assistive technology equipment for repair that is covered by an express guarantee, must provide a similar piece of equipment if the repair takes more than three (3) days.

Providing the substitute equipment shall not entail any charge to the consumer. The manufacturer, supplier, distributor, authorized dealer, or authorized lessor, as the case may be, shall provide new equipment to the consumer, within a term of twenty (20) days, when the equipment covered by an express guarantee undergoes three (3) repairs for the same defect. If the manufacturer, supplier, distributor, authorized dealer, or authorized lessor, as the case may be, is unable to replace the defective equipment with one of identical value and operation, he/she shall provide other equipment similar in value and operation.
