Rule 3121 - Stay Of Execution, Setting Aside Execution(c) After the sale of real estate has been advertised, an order to stay execution will be conditioned upon the advertising costs incurred being paid by defendant, unless, on cause shown, the application could not have been made with reasonable diligence before the sale was advertised. Any order to stay execution, with the execution of a judgment entered on confession, will be conditioned upon payment of costs by defendant unless execution was issued within seven (7) days after the entry of judgment, and in the latter event, the plaintiff will bear the costs. An order staying a writ of execution upon personal property shall not affect the plaintiffs right to have a levy made, unless the order shall direct the sheriff to return the writ without a levy.
