Section 1-9 - Conduct of the Hearing

The hearing officer shall conduct the hearing in accordance with the Wyoming Administrative Procedure Act W.S. 16-3-101 through 16-3-115.

(a) The hearing officer shall ensure that each party to the hearing is afforded, at their own discretion and expense, the opportunity to be accompanied and advised by counsel or duly qualified representative, to present evidence, to confront, cross examine and compel attendance of witnesses, to obtain a tape recording of the hearing without charge or undue delay, and to obtain the written decision of the hearing officer.

(b) The hearing officer shall permit the attendance of the contestant at the hearing.

(c) The hearing officer may open the hearing to the public only upon the request of the contestant.

(d) The hearing officer may prohibit the introduction of any evidence offered by a party which has not been disclosed to the other party consistent with the requirements of subsection d. of Section 8.

(e) The hearing officer shall ensure that a written or electronic verbatim record of the hearing is prepared.

(f) Either party to the hearing may request in writing the hearing officer to grant a continuance. The continuance shall be granted upon a showing of good cause. Any continuance shall extend the time for rendering a decision by the hearing officer for a period only equal to the length of the continuance.
