Section 1-8 - Pre-Hearing Procedures

The hearing officer shall be responsible for arranging the hearing within the 45 calendar day limit.

(a) The hearing officer shall provide the contestant or contestant's representative with written notice of the date, time, and location of the hearing.

(b) The hearing officer shall ensure that the hearing is conducted at a time and place reasonably convenient to the contestant.

(c) At the discretion of the hearing officer or upon the request of either party, a pre-hearing conference shall be held in a manner set forth in Rule 16 of the Wyoming Rules of Civil Procedure, provided that in no event will such prehearing conference be held later than five calendar days prior to the hearing.

(d) Each party shall disclose to the other the full name, title, occupation, and place of employment of each witness, a capsule summary of the witnesses testimony, and any other evidence to be presented. These disclosures must be made at least five calendar days prior to the hearing.

(e) During a pre-hearing conference conducted pursuant to this section, or in the alternative through the delivery of written notice, the hearing officer shall ensure that the contestant is provided a full explanation of the hearing procedures established in Section 9.
