Section 583.5 - Establishment of the pre-admission certification committees
(a) A pre-admission certification committee shall be established for geographic areas which are coterminous with the regions of the Office of Mental Health.
(b) The Commissioner of Mental Health, the Commissioner of Social Services and the Commissioner of Education shall each designate a specific person as a member of the pre- admission certification committee in each region. In designating such persons, the commissioners shall assure that the interests of the people residing in the region are represented such committee shall be an independent team.
(c) Prior to designating pre-admission certification committee members, the Commissioner of Mental Health shall consult with the Conference of Local Mental Hygiene Directors and the Commissioner of Social Services shall consult with county commissioners of social services within the region.
(d) Pre-admission certification committee members shall be psychiatrists, physicians, nurses, psychologists or social workers as defined in this Part, and shall have experience in the assessment and treatment of mental illness, preferably in the area of children and youth.
(e) If the persons designated to the pre-admission certification committee do not include a psychiatrist or physician, the Commissioner of Mental Health shall designate a psychiatrist or physician to serve as an additional member.
(f) Pre-admission certification committee members shall not have an affiliation with a residential treatment facility as member of the governing body, an employee or a consultant.
(g) Pre-admission certification committee members may be employees of the State of New York but this is not a requirement.
