Section 583.4 - Definitions
(a) Child is an individual who has passed at least his/her 5th birthday, and who has not yet reached his/her 22nd birthday.
(b) Committee on the handicapped is a multidisciplinary team established in accordance with the provisions of the New York State Education Law to evaluate each handicapped child who resides within a school district.
(c) Likelihood of serious harm is a substantial risk of physical harm to other persons as manifested by recent homicidal or other violent behavior by which others are placed in reasonable fear of serious physical harm.
(d) Mental illness means an affliction with a mental disease or mental condition which is manifested by a disorder or disturbance in behavior, feeling, thinking, or judgment to such an extent that the person afflicted requires care, treatment and rehabilitation.
(e) Nurse is an individual who is currently licensed as a registered professional nurse by the New York State Education Department.
(f) Physician is an individual who is currently licensed to practice medicine by the New York State Education Department.
(g) Psychiatrist is an individual who is currently licensed as a physician by the New York State Education Department and who is certified by, or is eligible to be certified by, the American Board of Psychiatry and Neurology as a psychiatrist or a child psychiatrist.
(h) Psychologist is an individual who is currently licensed as a psychologist by the New York State Education Department.
(i) Region is a geographically defined area within the State established by the Commissioner of Mental Health. Such regions are established for the purpose of administering those matters under the jurisdiction of the commissioner.
(j) Residential treatment facility is a residential treatment facility for children and youth as defined in Part 584 of this Chapter.
(k) Social worker is an individual who is currently licensed as a certified social worker by the New York State Education Department.
