Section 7 AAC 35.320 - Assuming jurisdiction,
(a) Only the state medical examiner may assume jurisdiction after evaluating all the available information gathered during the medicolegal death investigation.
(b) The state medical examiner, after evaluating all available information gathered during the medicolegal death investigation,
(1) will assume jurisdiction on an apparent homicide, and the department will transport the remains of the deceased person to the office or another location for examination;
(2) will assume jurisdiction on the following, and the department may transport the remains of the deceased person to the office or another location for examination:
(A) an apparent accident;
(B) an apparent suicide;
(3) may assume jurisdiction on the following, and the department may transport the remains of the deceased person to the office or another location for examination:
(A) a stillborn infant;
(B) a death that occurred while the deceased person was in the custody of, or was being taken into the custody of, the state or a political subdivision of the state or a public officer or agent of the state or a political subdivision of the state;
(C) a death that occurred in a jail or corrections facility owned or operated by the state or a political subdivision of the state or in a facility for the placement of persons in the custody or under the supervision of the state;
(D) a death that apparently resulted from a disease that constitutes a threat to public health;
(E) a death associated with a diagnostic or therapeutic procedure;
(F) an apparently natural death that occurred suddenly when the decedent was in apparent good health;
(G) an apparently natural, unattended death; and
(4) will decline jurisdiction, except as provided in (1) and (2) of this subsection, on a case if, in the opinion of the state medical examiner, the death does not warrant further investigation.
