Section 58-33-135 - [Effective 1/1/2025] Unfair or deceptive practices by pharmacy benefits manager The following acts or practices by a pharmacy benefits manager are declared to be misleading, deceptive, or unfair:
(1) Prohibiting a pharmacist or pharmacy from providing cost-sharing information regarding the amount that a covered individual may pay for a particular prescription drug from a pharmacist or pharmacy;(2) Penalizing a pharmacist or pharmacy for providing cost-sharing information on the amount that a covered individual may pay for a particular prescription drug from a pharmacist or pharmacy; and(3) Committing a discriminatory act, as prohibited in § 58-29E-15.Amended by S.L. 2024, ch. 203,s. 6, eff. 1/1/2025.Added by S.L. 2018, ch. 281,s. 2, eff. 7/1/2018.This section is set out more than once due to postponed, multiple, or conflicting amendments.
