§ 366. Trial-basis district—Formation; review of decisions

Within a period of sixty (60) days on and after the publication of the last notice in a newspaper of general circulation, as provided in § 365 of this title, any owner of a tract of land which has not been included in the Irrigation District on a trial basis, may request of the Authority that the same be included in the District, and, if it has been included, he may request that same be excluded therefrom. The Authority and the Department of Agriculture shall hear and consider the reasons adduced by such owner. The Authority, in consultation with the Secretary of Agriculture, shall determine the inclusion or exclusion of such tract of land in or from the District during the trial period, taking into consideration all interests involved in the case. Whatever determination the Authority may make in this respect, on consulting with the Secretary of Agriculture, after listening to such owner, shall be prima facie true and correct.
