No infrastructure agency shall approve or finance new or existing infrastructure projects unless the same are consistent with at least three (3) of the criteria established in § 9043 of this title. The Secretary, Head, or Executive Director of the state or municipal infrastructure agency shall be responsible for ascertaining that the project is, to the extent possible, feasible and compatible with the criteria.
