(a) Municipalities that fail to comply with the promotion prohibition set forth in this chapter shall be punished by a ten thousand dollar ($10,000) fine. The Secretary of the Department of Natural and Environmental Resources shall administer these sanctions and fifty percent (50%) of the revenues generated by such fines shall be allocated to nonprofit organizations for use in the development of environmental projects. The remaining fifty percent (50%) shall be used by the Department of Natural and Environmental Resources for promotional expenses related to this chapter and for expenses incurred by the Committee while carrying out its functions, duties, and powers as provided by this chapter.
(b) The Department of Natural and Environmental Resources may establish conditions within its scope of competence to require municipalities to comply with the payment of any sanction imposed under this chapter.
(c) Municipalities owing fines, or a portion thereof, to the Department of Natural and Environmental Resources for violations of the promotion prohibition set forth in this chapter shall not participate in the designation of municipalities with green initiatives until they meet the imposed obligation.
