§ 972. Application

The applicability of the special procedure herein established shall be circumscribed to the following criteria:

(a) This chapter and the special procedure established by the same shall be implemented by the Regulations and Permits Administration concerning the procedures related to buildings devoted to institutional use for the benefit of the community that at the same time are located within municipal territorial boundaries and whose municipality has not acquired the power to have jurisdiction over the processes for obtaining permits by virtue of the approval of a hierarchy transference agreement and pursuant to §§ 4001 et seq. of this title, known as the “Autonomous Municipalities of the Commonwealth of Puerto Rico Act of 1991”.

(b) Provided, That in those municipalities that have acquired the power to have jurisdiction over the processes for obtaining permits, the Special Communities, unlike the municipalities provided in the preceding subsection, shall execute the special procedure instituted in § 972b of this title through the corresponding municipal unit for obtaining the corresponding permits for use set forth in this chapter. However, they shall file a copy of the documents required with the Regulations and Permits Administration.
