§ 1095b. Office of the Urbanism Director—Executive Director; powers and duties

The Executive Director of the Directory shall have all the necessary powers needed to carry out his/her responsibilities pursuant to this chapter, and to achieve the objectives pursued by the same, including, but not limited to the following:

(a) Establish with the approval of the Secretary of Transportation and Public Works, the internal organization of the Office of the Director and the systems needed for its adequate functioning and operation.

(b) Adopt such regulations that are needed for the implementation of this chapter with regard to the faculties vested in the Office of the Director.

(c) Recommend to the Secretary of Transportation and Public Works to appoint such personnel deemed necessary to perform his/her responsibilities under this chapter without being subject to the laws of personnel of the Commonwealth of Puerto Rico.

(d) Recommend to the Secretary of Transportation and Public Works to contract, without holding auctions, the technical and professional services necessary to carry out the purposes of this chapter. In addition, the Directorship shall recommend to the Secretary the contracting of the services of employees and officials of any political agency, instrumentality or dependency of the Commonwealth of Puerto Rico outside working hours, and to pay the due compensation for the additional services rendered. The public employees and officials so contracted by the Secretary shall not be subject to subsection (f) of § 1822 of Title 3, part of the “Puerto Rico Ethics in Government Act”, nor the provisions set forth in § 551 of Title 3. [These] provisions shall be of application exclusively for the artist or persons who expose their works of art in the revitalization of urban centers.

(e) Design, prepare, and execute a promotion plan addressed to guide and provide incentives for the revitalization of urban centers.

(f) Inspect the works whenever he/she may deem convenient, to verify that the same is being performed according to the specifications itemized in the approved proposal.

(g) Conduct a final inspection of the work once it is completed. This inspection must confirm that it was executed according to the original or amended petition. Otherwise, it will not benefit from the economic incentives listed in this chapter.

(h) Execute all necessary administrative and management orders to promote the urban renewal purpose set forth in this chapter.

(i) Plan, direct, and supervise all activities, operations, and transactions of the Office of the Director and represent it in all acts and agreements required.

(j) Evaluate the proposed projects that promote the revitalization of urban centers and foster those that meet the objectives set forth in this chapter.

(k) Offer assistance to municipalities, persons, or private entities, that promote projects to revitalize urban centers, that are susceptible [sic] to be developed by the Office of the Director with regard to their planning, design, and performance.

(l) Assist in the process of acquiring government permits that are needed to execute the revitalization.

(m) Develop, provide incentives, establish, and coordinate projects and activities addressed to revitalize the urban centers.

(n) Coordinate economic, social, and cultural aspects inherent to the revitalization of the urban centers.

(o) Prepare and submit, to the Secretary an annual or periodical report as required on the progress of the revitalization program.

(p) All those functions and duties deemed necessary and convenient to attain the objectives of this chapter.

In the case of the municipalities that have adopted the area plan for the urban center or historic zone, the functions listed in § 1095a of this title and in subsections (e), (f), (g), (j), (m), (n), and (p) of this section, correspond[ing] to the Territorial Ordinance Office of those municipalities.
