To cremate human remains, at least forty-eight (48) hours must have elapsed from the time of death, except under the following circumstances:
(1) When human remains show early signs of decomposition in the judgment of the director of the crematory.
(2) When the Prosecutor’s Office has investigated the death before forty-eight (48) hours from the death have elapsed, in which case the prosecutor in charge of the investigation may request the authorization to conduct the cremation.
