An authorization from the Secretary of the Department of Health is required to perform the cremation of human remains. A signed petition from the interested party is required for the issuance of such authorization. If there is no interested party, the Secretary may issue an authorization upon request from the Director of the Crematory. An authorization may also be issued by submitting a certificate issued by the Institute of Forensic Sciences duly signed by the physician who performed the autopsy, examined the remains or the medical record or death certificate stating the illness or immediate cause of death; or upon petition from the Prosecutor’s Office of the Department of Justice. No human remains shall be embalmed without previous authorization from the Institute of Forensic Sciences.
