§ 3334. Commission—Composition

The Program shall operate with the advice of an Interagency Commission for Children’s Medical Emergencies, henceforth the “Commission”, constituted by five ex officio members who shall be the Secretary of Health, as Chairperson, the Dean of the Medical Sciences Campus, the Medical Director of the University Pediatric Hospital, the Executive Director of the 9-1-1 Emergency Service, the Executive Director of the Commonwealth Medical Emergencies or their representatives and by four (4) members who shall be directly appointed by the Governor as representatives of those sectors responsible for all health matters, to wit: one (1) pediatrician, one (1) nursing professional, one (1) health educator and one (1) representative of the community.

(a) All members of the Interagency Commission appointed by the Governor shall exercise their office for a term of four (4) years and until their successors themselves take office. Said members may not be appointed for more than two (2) consecutive terms.

(b) The Governor, on his or her own initiative or at the request of the Commission may dismiss any member of the Commission in cases of desertion or negligence in the performance of his or her duties or because of unjustified failure to attend the Commission’s meetings on more than three (3) consecutive occasions or for any other justified cause, after charges have been brought and the member has been given the opportunity to be heard.

(c) The members of the Commission, with the exception of the Government officials, shall receive a per diem of sixty dollars ($60) for each day they attend the meetings or conduct official business of the Commission. They shall also be entitled to payment for the miles traveled while in the performance of their duties as provided in the regulations of the Department of the Treasury of the Commonwealth of Puerto Rico.

(d) Should the office of the Chairperson fall vacant, or during the latter’s absence, the senior member shall perform the duties of the Chairperson until the vacancy is filled or the temporary absence has ceased. Should there be more than one member with equal seniority, the Commission members shall select the temporary Chairperson.

(e) Should a vacancy arise among the members of the Commission, the Governor shall fill said vacancy within a term of sixty (60) days as of the date the vacancy occurred for the remaining the term of the member who gave rise to said vacancy.
