§ 7072. Bariatric surgery—Options

Every health insurance company, health services organization and health maintenance organizations as defined in subsection (x) of Section 1 of Act No. 101 of June 26, 1965, as amended [sic], doing business in the jurisdiction of the Commonwealth of Puerto Rico, shall provide, subject to preauthorization, in its policy for the payment of one of the types of bariatric surgery authorized in this chapter for treating morbid obesity. The Health Insurance Administration of Puerto Rico, health insurers, health services organizations and health maintenance organizations as defined in subsection (x) Section 1 of Act No. 101 of June 26, 1965, as amended [sic], may require within the policies that insurers and beneficiaries comply with a waiting period, which shall not exceed twelve (12) months, before covering the benefits set forth in this chapter, unless a physician certifies that the life of the patient is in imminent danger.
