Every person who violates the provisions of §§ 796—801 of this title shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not to exceed two hundred dollars ($200) for the first offense. Every person convicted of subsequent violations of the provisions of §§ 796—801 of this title shall be punished by confinement in jail for from one (1) to twenty (20) months, in the discretion of the court, the circumstances in each case to be considered.
