All health facilities have under this chapter the following duties and responsibilities:
(a) To notify the Department of any case of nosocomial infection occurring at their facilities pursuant to the provisions of § 363 of this title.
(b) They shall be under the obligation to take the necessary measures in order to prevent or reduce the risk of acquiring nosocomial infections for patients, employees and visitors.
At the least, they shall develop norms and procedures concerning:
(1) Biomedical waste management.
(2) Isolation practices.
(3) Sterilization of supplies and equipment.
(4) Prophylactic use of antibiotics.
(5) Cleaning and disinfection of floors and surfaces.
(c) They shall be under the obligation to render a semiannual report to the Department which contains the analysis of the nosocomial infections occurred, as well as the trends found and the actions taken.
(d) They shall have available for inspection at any time by the Department, the registers and reports referred to in preceding subsections.
(e) They shall have the obligation to establish a program for nosocomial infection prevention, control and research. This program shall include a process to identify and monitor nosocomial infections not to be limited to the following:
(1) Infections relative to surgical incisions.
(2) Infections acquired in intensive care units.
(3) Infections acquired by newborns.
(4) Infections acquired by patients on mechanical ventilation; on enteral feeding; or under invasive treatments or procedures.
(5) Infections caused by antibiotic-resistant organisms.
(6) Tuberculosis.
