§ 2095. Examinations

The Board shall offer a theoretical and a practical examination at least twice a year. The Board shall establish the dates of said examinations at the first meeting of each year. Such examinations shall include the topics and be conducted in the manner may determined [sic] by the Board regulations. The examination shall be offered in English or Spanish at the candidate’s choice.

The Board shall obtain the advice of professionals with expertise in the technique of preparing examinations in order to ensure the worth thereof as tools to measure knowledge and skills.

Any person who, as of the effectiveness of this act, fails to [pass] the revalidation examination on three (3) different occasions, can not take a new examination until he/she submits to the Board satisfactory evidence that he/she has taken and [passed] the corresponding course or courses; after his/her particular situation is evaluated by the Board. Once the person has taken and [passed] the course or courses required herein, he/she may take the examination on two (2) additional occasions.

If these courses are not available, the candidate, with the express authorization of the Board, shall have two (2) additional opportunities to take the revalidation examination without being required to take said course.

The Board shall adopt norms that ensure that the candidates who do not [pass] the revalidation, shall have the right to examine their answer sheets, receive a breakdown of their grading, and request the reconsideration of the grading of the examination. A term of ninety (90) days shall be granted to any person who has taken the examination, as of the date on the result of the examination is notified to him/her, to file any allegation in his/her behalf, with respect to the grad ing of examinations. The examination papers of those who have passed it may be destroyed after the abovementioned ninety (90) days have elapsed. The Board shall hold the examination papers of the last two (2) times that the person failed to pass the examination, with the purpose of expediting the process established in this section.

It shall also be provided that prior to taking the examination, the candidate shall receive guidance that will familiarize him/her with the revalidation process; the standards that govern the administration of the examination, the type of examination and the evaluation method thereof, as well as the Board’s regulations.

The Board shall prepare and publish a handbook containing all the information concerning to the revalidation examination, a copy of which shall be available and handed to every person who requests to be admitted to the examination, after presenting of a ten-dollar ($10) voucher.

The Board shall review the cost of this revalidation handbook from time to time, taking as a basis the cost of preparing and publishing the handbook, but the amount to be charged shall not exceed the true cost of such expense.
