§ 1043. Penalties

(1) Any person who incurs in a violation of §§ 1032 or 1042 of this title shall incur in a misdemeanor and, upon conviction, shall be punished by a fine of not less than five hundred dollars ($500), or by imprisonment for a term of not less than one (1) month, or by both penalties [at] the discretion of the court for the first violation. For the second and subsequent violations, upon conviction, he shall be punished by imprisonment for a term of not less than six (6) months.

(2) Any person who deliberately makes a false declaration in his license petition for purposes of this chapter shall incur in a misdemeanor punishable by a fine of not less than five hundred dollars ($500) or by imprisonment for a term of not less than three (3) months or by both penalties [at] the discretion of the court.
