§ 544s. Contact lenses

No optometrist or certified optometrist shall be bound to issue a prescription for contact lenses. Whoever wishes to, or who by a justified petition of a client issues a prescription for contact lenses, may do so provided that he or she has personally evaluated the vision, movement, adjustment and compatibility of the lenses and determined the best regime the patient shall follow for using and cleaning said lenses.

For an optometrist or certified optometrist to allow or cause a person who is not an ophthalmologist, optometrist or certified optometrist to use the prescription of an ophthalmologist, optometrist or certified optometrist to adjust and evaluate a contact lens shall be deemed as a dishonest practice. Every optometrist must personally evaluate the adjustment, behavior, qualities and characteristics of the contact lens after placing it in the patient’s eye in order to ensure satisfactory vision and compatibility and reduce the complications associated with the improper or inadequate use thereof. He or she must also recommend solutions for the maintenance of contact lenses, ensuring that they are compatible with the patient’s eye. Said information must be included in the patient’s record. This section shall not be interpreted as limiting the optometrist or certified optometrist to be assisted while placing the contact lens, but never while conducting its adjustment and evaluation.
