§ 1320c. Municipal consortia

(a) Municipalities may, by agreement and in coordination with the Authority, unite to constitute a syndicate which shall be responsible for the developing and implementation of a common Recycling Plan for all the municipalities constituting the same, provided said agreement provides the Plan with financial viability. In such a case, the municipalities constituting the syndicate are hereby relieved from developing individual plans.

(b) All the powers and functions conferred to the municipalities, as defined in § 1320b of this title, are hereby conferred to municipal syndicates.

(c) The agreement established by the syndicate shall contain at least:

(1) The effective date of the agreement.

(2) Financial and any other type of accountability of each municipality.

(3) Financial or any other kind of rights or benefits corresponding to each municipality.

(4) Definition of the agency or body representing the syndicate.

(d) Municipalities that constitute the agreement shall not withdraw from the same during the term of effectiveness.

(e) Municipalities that are not part of the syndicate and subsequently are interested in becoming a part thereof, must be approved by the majority of the participating municipalities, and by the Authority. The Authority may reevaluate the decision made by the participating municipalities and make a final decision thereon.

(f) Any proposal for syndication must be submitted to the consideration of the Authority for its approval.

(g) The Authority shall provide the municipal consortia with the technical assistance needed to develop the Recycling Plan.
