§ 23. Facilities, docks and infrastructure

The Secretary shall be empowered to construct, improve and administer facilities near the aquatic and maritime resources of the Commonwealth of Puerto Rico for the use and enjoyment thereof by the citizenry, fishermen, and tourists who wish to enjoy the fishing sport as defined in this chapter, allowing the Secretary of Recreation and Sports to administer the passive recreation areas, including picnic areas and similar facilities. The Secretary of Recreation and Sports may establish cooperative agreements with municipalities, nonprofit entities or private entities for the development of these passive recreation areas.

The new facilities shall be constructed taking into consideration the needs of persons with physical disabilities and the applicable federal and state legislation. The existing facilities shall be rehabilitated and adapted to the purposes of this chapter.

Said facilities shall also have parking and passive recreational areas in order to protect the environment and resources of the area, as well as surveillance and information posts administered by the Department. The docks thus constructed or restored shall be for public use, and all structures, as well as the areas in which this chapter is developed and implemented shall be considered to be parks or environmental reserves.
