§ 4859. Knowledge of nonpayment

It constitutes prima facie evidence of knowledge of the insufficiency of funds in the closed or non-existent account, the cancellation of the account, or the lack of express authorization to overdraw if the drawer or endorser writes, issues or releases a check, money order, draft or note the payment of which is refused by the drawee through any of the following: insufficiency of funds, drawing against a closed or non-existent account, the cancellation of the account designated for the payment or for not having express authorization to overdraw.
