§ 1724s. Forfeited property—Alternative uniform administrative procedure; Board evaluation

Once the petition has been received, the Administrative Director of the Board may reject it outright or refer the matter to a lawyer from the Department of Justice, who shall evaluate the petition and shall make a recommendation with findings of fact and conclusions of law within fifteen (15) days after the filing date of the petition. The Administrative Director, or his/her delegate, may adopt or reject the determination if he/she concludes that it has no legal basis and shall notify the petitioner accordingly.

If the Administrative Director, or his/her delegate, outright reject the petition or fail to act on the same within said fifteen (15) days, the term to file a petition to contest the forfeiture pursuant to the provisions herein shall begin to count once again from the date on which the petitioner receives a copy of the notice of rejection, or after the fifteen (15)-day term has elapsed, as the case may be.
