§ 1724r. Forfeited property—Alternative uniform administrative procedure

The Forfeiture Board shall establish an alternative administrative procedure to return forfeited property. Said procedure shall not be considered as a requirement or obligation for a party to file and resolve a dispute.

The party interested in availing itself of this administrative procedure shall file a sworn petition with the Forfeiture Board within fifteen (15) days following the date of receipt of the forfeiture notice. The petition shall include the following:

(a) The names and mailing addresses of all parties with knowledge of the facts stated in the petition.

(b) Any documents which prove that the property was unduly forfeited.

(c) The relief requested.

When availing him/herself of the alternative uniform administrative procedure before the Forfeiture Board, the petitioner must exhaust all the administrative remedies available before resorting to the judicial forum to exercise his/her right to file a complaint to contest the forfeiture in accordance with this title.
