§ 1456. Administrator—Faculties

In addition to the duties conferred to the Administration by this chapter, the Administrator shall have but not be limited to the following powers and duties:

(a) Establish, with the approval of the Secretary and the coordination and advice of the Office of Management and Budget, the internal organization of the Administration that is needed for its adequate functioning and operation.

(b) To collaborate with the Secretary in the identification and execution of strategies addressed to improve the quality of [life] and economic development of the communities and housing projects served directly or indirectly by the Department, by promoting programs focused to such purposes.

(c) To execute all administrative and management actions needed to implement this chapter and the regulations adopted by virtue thereof, as well as any other laws, regulations, services or programs attached to the Administration.

(ch) To plan, direct and supervise all the activities, operations and transactions of the Administration and represent it in all the acts and agreements that are required therefor.

(d) Appoint the personnel needed for the implementation of this chapter, that must avail itself of the benefits of §§ 761 et seq. of Title 3, which establishes the Puerto Rico Commonwealth Employees Savings and Loan Fund. The Administration shall be an individual administrator, for the purposes of Act No. 5 of October 14, 1975, known as “Public Service Personnel Act of Puerto Rico”.

(e) To contract, with the prior authorization of the Secretary, whatever technical and professional services that may be needed to carry out the purposes of this chapter, subject to applicable rules and regulations.

(f) To delegate on any official and employee of the Administration, within the corresponding parameters, the functions, duties and responsibilities conferred in this chapter, except those of making appointments, imposing disciplinary measures, removing employees from their positions, through dismissal or discharge, and to fix salaries and any personal transaction, enter into contracts and approve regulations.

(g) To prepare the budget, control and decide the nature and necessity of all the Administration’s expenses, as well as the manner they shall be incurred, authorized and paid, subject to the provisions of the regulations for the disbursement of public funds of the Department of the Treasury and the guidelines and instructions of the Office of Management and Budget. The Administrator shall obtain the endorsement of the Secretary before presenting the budget to the Office of Management and Budget.

(h) To carry out all the activities, contracts, agreements and programs that may be proper, necessary and convenient to comply with the purposes of this chapter, subject to availability of resources.

(i) To periodically assess the programs and norms for the development of procedures, methods and systems that will allow the redirection of the Administration’s efforts according to changing needs in the areas of services and activities entrusted by this chapter.

(j) To receive money, equipment, goods or services, through gift, usufruct or any other legal form, from other agencies or municipalities of the Government of Puerto Rico or of the Government of the United States of America, or from any private person, for their goals and purposes. The Administration shall have the power to request and accept gifts, or funds from appropriations, services, materials, properties or other similar benefits, from any private or nonprofit person or institution, or from the Government of Puerto Rico, the federal government, or from municipal governments, or from any instrumentality or agency thereof; and to advise or execute contracts and agreements with any of said governments or their agencies, or with persons or private entities, and to enter in contracts or agreements with any of such governments or their agencies for the use of such gifts or funds, solely in accordance with the purposes and goals of the Administration and subject to the provisions of this chapter and the regulations approved by virtue thereof. The funds received proceeding from gifts shall be used pursuant to the conditions of each gift and the applicable laws.

(k) To render an annual report to the Secretary on the activities of the Administration, the funds appropriated or produced during the corresponding report year, their source, the disbursements and surplus money, if any.

(l) To appoint and organize commissions, committees, boards, councils, associations or bodies of any other nature, to promote the most encompassing participation of citizens in the efforts of the Administration in favor of the persons to whom it is directed.

(m) To promote, sponsor and participate in conferences, seminars, study groups, investigation centers and any kind of activity, whether educational or of any other nature, provided they are compatible with the purposes of this chapter to establish information exchange systems specific to the social and economic problems of the country.
