In case that any municipality comprised within the benefits of §§ 12—18 of this title decides to pave the said sections of roads or to provide a macadam of better quality than that which may be constructed by the Department of Transportation and Public Works, the Secretary may turn over to the municipality the said sections of roads. The assignment or transfer of such sections by the municipalities to the Secretary of Transportation and Public Works, or vice-versa, shall be entered upon the minutes of the meeting held for the purpose by the municipal legislature. The said minutes shall also be signed by the representative of the Secretary of Transportation and Public Works, making the delivery or receiving the said sections or roads, and a copy of said minutes shall be transmitted to the Secretary of Transportation and Public Works and to the Secretary of State.
