§ 1204a. Museum of Contemporary Art

(a) Public policy. — It is hereby stated to be a public policy of the Commonwealth of Puerto Rico the granting of continuing financial aid to the Museum of Contemporary Art to promote [the] plastic arts [among] our youth, maintain a museum of pictorial and sculptural works of art, carry out educational and cultural activities, and maintain [a] document center on contemporary art accessible to the general public.

(b) Unclaimed funds. — The funds not claimed by the Museum of Contemporary Art at the close of each fiscal year shall be used by the Institute of Puerto Rican Culture during the following three fiscal years for the acquisition of works of art.

(c) Regulation. — The Institute of Puerto Rican Culture is hereby directed to draw up the pertinent regulations to establish the procedures and requirements under which the funds consigned in the annual budget of the Commonwealth of Puerto Rico are to be given to the Museum of Contemporary Art. Providing, That in the event said regulations are not in effect for the budget request of fiscal year 1995-1996, the Institute of Puerto Rican Culture shall be governed by the same norms and criteria it currently uses to hand over the items appropriated to the Ponce Art Museum or the Luis Muñoz Marín Foundation.

(d) Additional funds. — The provisions in subsections (a)—(c) of this section shall not limit the authority of the Legislature to appropriate additional funds to the Museum of Contemporary Art from unencumbered funds in the Commonwealth Government Budget through a Joint Resolution approved for such purposes.

(e) Recourse of mandamus. — The Museum of Contemporary Art may resort to a mandamus, pursuant to the provisions of the Code of Civil Procedure, in order to enforce the provisions of this section.
