Section 13-25-2-16 - Civil actions by state or unit of local government The state or a unit of local government may commence a civil action against an owner or operator of a facility for failure to do any of the following:
(1) Provide notification to the emergency response commission under section 3 of this chapter.(2) Submit a material safety data sheet or a list under section 8 of this chapter.(3) Make available information requested under section 8 of this chapter.(4) Complete and submit an inventory form under section 9 of this chapter containing tier I information unless the requirement does not apply under section 9(b) of this chapter.Pre-1996 Recodification Citation: 13-7-37-20(b).
