Rule 80.6 - Change of Name(a) Adults.(1) An adult who wishes to change his or her name may file a petition with the probate division. The petition shall substantially conform to the form approved pursuant to Rule 84. (2) Upon the filing of a petition under paragraph (1), the court shall request the department of public safety to determine whether the petitioner's name appears on the sex offender registry established by 13 V.S.A. § 5402. By filing the petition, the petitioner consents to the making of the request by the court and the disclosure of the information by the department. (3) If the department of public safety reports that the petitioner's name appears on the sex offender registry, the court shall permit the department to appear on the question of whether there is a compelling reason for granting the petition. (b) Minors. A parent or guardian of a minor who wishes to change the name of the minor may file a petition with the probate court. The petition shall substantially conform to the approved form contained in the Appendix of Forms. Consent of a parent or a guardian to a minor's change of name may be obtained pursuant to Rule 16. A parent or guardian who has not consented to the change of name shall be notified pursuant to Rule 4 of the commencement of the proceedings. (c) Venue. The petition shall be filed in the probate court of the district of residence of the person whose name is sought to be changed.
