Rule 26 - [Effective 1/1/2025] Action by the Court of Appeals in Industrial Commission Matters
(a) Disposition. The Court of Appeals may dismiss a special action petition on any ground applicable to civil appeals. The court may decide a case on the merits only by an opinion or a memorandum decision stating the grounds.
(b) Scope of Review. The Court of Appeals' review must be limited to determining whether the Commission acted without or in excess of its power and, if findings of fact were made, whether such findings of fact support the award.
(c) Costs Against the Commission. Costs may not be assessed against the Commission.
(d) Petition for Review. A party may seek review of a disposition by filing a petition for review in the Supreme Court as provided in ARCAP 23.
(e) Effectiveness of Disposition. A disposition will become effective as provided in Rules 18(c) and (d).
