The confidential intermediary or representative of the training organization complained of shall appear before the Commission to review the complaint or allegation of misconduct. The Commission shalI provide the opportunity for the confidential intermediary or training organization to give an account regarding the complaint and provide any documentation supporting the confidential intermediary's or training organization's position. The individual or entity bringing the complaint against the confidential intermediary or training organization may also be called by the Commission to appear at the hearing.
Upon review of the facts before the Commission, the Commission shall decide whether the confidential intermediary or training organization shall be retained or removed, and what discipline, if any, shall be taken. A decision to remove a confidential intermediary or training organization shall be determined by a majority vote of the Commission members.
