(a) all agencies and organizations receiving criminal history information from the Division must ensure that the information is released only to authorized individuals. This information is confidential.
(b) All non-criminal justice agencies and organizations receiving criminal history information are responsible for adopting security measures designed to prevent unauthorized access, dissemination or disclosure of such information, and must at a minimum:
(c) All criminal justice agencies receiving criminal history information shall maintain the same security measures set forth in subsection (b) above, except that receipt need not be restricted to the director or supervisor or one person specifically designated by the director or supervisor. Receipt and access shall be restricted to those persons designated by the director or supervisor of the criminal justice agency.
(d) Security guidelines relating to the NCIC III files are set forth in the NCIC CCH Program Background, Concept and Policy Board on March 1, 1984 (Policy Paper), and Subparts A and C of the United States Department of Justice Regulations governing the dissemination of criminal records and criminal history information (Regulations), published in the Federal Register on May 20, 1975, and August 7, 1976 (Title 28, Code of Federal Regulations, Part 20). Copies of these documents may be obtained from the FBI NCIC Section, Washington, D.C., 20535. Additional guidelines for state III files appear in the Regulations published in the Federal Register on March 19, 1976.
