Section 56-3-53 - Emergency Medical Personnel
53.1. Emergency personnel in coal mines, emergency medical personnel.
53.1.1. The following emergency personnel and emergency medical personnel shall be employed in every mine in the state.
53.1.1.a. At least one (1) emergency medical attendant as defined in W. Va. Code § 22A-8-1et seq.;
53.1.1.b. A paramedic as defined in title 64, series 48, section 2.38 of the West Virginia Code of State Rules; or
53.1.1.c. A physician assistant as defined in W. Va. Code § 30-3E-1.
53.1.2. Every operator shall be required to provide each of the emergency personnel and emergency medical personnel listed in the above subdivision for every seventy (70) employees for every seventy (70) employees or any part thereof who are engaged at one (1) time, in the extraction, production or preparation of coal.
53.1.3. The provisions of this section shall not apply to mines employing no more than ten (10) employees.
53.1.4. Emergency personnel and emergency medical personnel shall be employed at their regular duties at a central location convenient for quick response to emergencies, and further shall have available to them at all times such equipment as shall be prescribed by the director, in consultation with the commissioner of the bureau for public health.
