Section 38-4-31 - Inspection and Certification Requirements31.1. Inspection of all coal related dams shall be made by a qualified registered engineer or other qualified professional specialist under the direction of the professional engineer. The registered engineer shall provide a certification at least quarterly during construction, on final completion of construction and at least yearly until removal of the structure or release of the performance bond. The certification by the engineer shall be submitted to the Secretary with the inspection report to verify that the dam and its appurtenances have been constructed and maintained in conformance with the approved plans and specifications and these rules.
