Section 126-85-100 - Overclaim Disregard

100.1. The WVDE may disregard a Coordinated Review overclaim if the total SFA overclaim from an administrative review and all subsequent follow-up reviews does not exceed $600.00 per program (NSLP, SBP, SMP, After School Programs NSLP-Snack). However, no overclaim is to be disregarded where there is substantial evidence of violations of criminal law or civil fraud statutes.
