Section 74:52:03:05 - Reporting changes of operation

The following items must be reported to the secretary:

(1) The permittee must give notice to the secretary as soon as possible of any planned physical alterations or additions to the permitted facility. Notice is required only when the alteration or addition to a permitted facility meets the definition in § 74:52:01:01 of a new source or a new discharger or the alteration or addition could significantly change the nature or increase the quantity of any pollutants discharged;
(2) The permittee must give advance notice to the secretary of any planned changes in the permitted facility or activity which may result in noncompliance with permit requirements; and
(3) The permittee must notify the secretary if the permit is to be transferred to another person. The secretary may require modification or revocation and reissuance of the permit to change the name of the permittee and incorporate other necessary requirements.
