Section 74:52:02:12 - Additional requirements for new dischargers

The secretary may waive the reporting requirements for one or more of the pollutants listed in this subsection if the applicant has demonstrated that the waiver is appropriate because information adequate to support issuance of a permit can be obtained with less stringent requirements. If the applicant is a new discharger, the applicant must submit quantitative data on the parameters listed in this subdivision within two years after commencement of discharge. However, the applicant need not submit quantitative data which has already been performed and reported under the discharge monitoring requirements of the SWD permit. The requirements of this subdivision do not apply to pollutants present in a discharge solely as a result of their presence in intake water. The required parameters are as follows:

(1) A description of the frequency of flow and duration of any seasonal or intermittent discharge, except for storm water or spills;
(2) A brief description of any system used or to be used; and
(3) Any additional information the applicant wishes to be considered.
