Except as provided in subdivision 74:36:07:126(2), the owner or operator of an existing municipal solid waste landfill subject to the provisions of § 74:36:07:98 shall keep for at least five years, readily accessible, on-site records of the design capacity report, the current amount of solid waste in-place, and the year-by-year waste acceptance rate. Off-site records may be maintained if they are retrievable within four hours. Either paper copy or electronic formats are acceptable.
