Open burning of municipal solid waste is prohibited except as provided by § 74:36:15:03. Monthly open burning of agricultural wastes, silvicultural wastes, diseased trees, land clearing debris, untreated wood products, or storm debris which is free of special wastes as listed in § 74:27:13:17 is allowed. A facility shall confine burning to a separate area and shall supervise burning at all times.
