Section 64:75:04:05 - Disputed delinquency

Any retailer that receives a notice of delinquency in person or upon receipt of certified mail may, in writing, dispute the delinquency by providing to the wholesaler the retailers basis for the dispute. The written dispute must be received by the wholesaler within 5 days of receipt of notice, as evidenced by the date on the receipt of acceptance of certified mail or affidavit of acknowledgment. If the wholesaler does not receive a timely response, the delinquency is deemed admitted.
