Section 20:53:10:01 - Inspection exemption

A municipality may apply for permission to enforce a present inspection system or for permission to establish a new inspection system. An application shall be filed with the commission with a copy of the proposed ordinance, bylaw, or other action to be taken by the local municipality. The local municipality shall ensure the following:

(1) Any person performing local plumbing inspections meets the qualifications required of a state plumbing inspector; and

(2) The local plumbing inspector inspects all new plumbing, excluding plumbing repair work, within the jurisdiction of the local municipality to ensure compliance with state and local plumbing codes.

The local municipality shall immediately notify the commission if the local inspection system is temporarily or permanently terminated and turn over the records for all uncompleted inspections to the commission. The commission shall then resume inspections of the area under the rules of the commission.
