Section 250-RICR-120-05-25.6 - Applicability and ExemptionsA. Except as specified in § 25.6(B) of this Part, the provisions of this Part shall apply to any person who, on or after May 1, 2010, solicits the use of or applies asphalt for road paving, maintenance or repairs.B. The use of cutback asphalt or emulsified asphalt that does not comply with the provisions of § 25.7 of this Part shall be allowed provided that prior written approval is granted by the Director and the EPA. Any request for an approval under this section shall be made in writing and shall include, at a minimum, the following information: 1. The scope of the activity;2. An assessment of alternative materials and products available;3. The amount of VOC that would be admitted as a result of the activity;4. The dates during which the activity would occur; and,5. A demonstration that it is necessary that the activity take place during the period of time between May 1st and September 30th.C. Wherever the term Volatile Organic Compound or VOC is used in this regulation, this term should be read as Volatile Organic Compound and Halogenated Organic Compound or VOC and HOC.250 R.I.
