Section 69-05.2-04-09 - Areas unsuitable for mining - Commission responsibility for implementation for designating lands unsuitableThe commission will:
1. Not issue permits which are inconsistent with designations made under North Dakota Century Code chapter 38-14.1 and this article.2. Maintain a map of areas designated as unsuitable for all or certain types of mining operations.3. Make available to any person information within its control regarding designations, including mineral or elemental content which is potentially toxic in the environment, but excepting proprietary information on the chemical and physical properties of the coal or commercial leonardite according to subsection 3 of North Dakota Century Code section 38-14.1-13.N.D.
