Section 2830.2 - DefinitionsAs used in this Subchapter:
(a) Commissioner shall mean the Commissioner of the New York State Division of Housing and Community Renewal.(b) Division shall mean the New York State Division of Housing and Community Renewal.(c) Rural preservation activities or activities shall mean activities such as those designed to construct, maintain, preserve, repair, renovate, upgrade, improve, modernize, rehabilitate or otherwise prolong the useful life of housing accommodations; to restore abandoned and vacant, as well as occupied, housing accommodations to habitable and viable condition; to demolish structurally unsound or unsafe or otherwise unsightly or unhealthy residential structures which no longer serve or can economically be made to serve a useful purpose consistent with stabilizing or improving a region; to acquire and renovate buildings which contain housing accommodations; and to conduct similar activities with respect to retail, commercial, cultural, civic and community establishments within a region.(d) Persons of low income shall mean individuals and families whose annual incomes do not exceed 90 percent of the median annual income for all the residents of the region within which they reside, or a larger area encompassing such region for which annual income can be determined, taking family size into account.(e) Qualified applicant or applicant shall mean a not-for-profit corporation under contract pursuant to article XVIII of the Private Housing Finance Law, or any other locally based organization which is either incorporated under the Not-for-Profit Corporation Law (or such law together with any other applicable law) or, if unincorporated, is not organized for the private profit or benefit of its members.(f) Rural area of the State shall mean cities, towns and villages having a population of less than 20,000.(g) Region shall mean those portions of the rural area of the State within which rural preservation activities are to be carried out.(h) Rural area revitalization project or RARP shall mean a specific rural preservation activity or series of activities which the applicant proposes to undertake for the revitalization and improvement of a region of the rural area of the State.N.Y.
